Terms of Service
This Terms of Service Agreement (“Agreement”) is entered into by and between Museum solutions OÜ, registry code 17318232, with registered office at Rataskaevu tn 10, 10123 Tallinn, Estonia (hereinafter “Company”) and you, the user (“you”, “your”, “User”, “Customer”). It becomes effective as of the date you first use the website https://museumofillusions.ee/ (“Site”) or the date of your electronic acceptance of this Agreement.
This Agreement sets forth the general terms and conditions governing your access to, use of, and purchase of any services, tickets or other goods offered via our Site (collectively the “Services”). By using the Site or purchasing Services, you confirm that you have read, understood and agree to be bound by this Agreement and our Privacy Policy.
1. Eligibility
The Site and the Services are available only to Users who:
Are at least eighteen (18) years old or otherwise legally capable of entering into binding contracts under Estonian law;
Are not barred from purchasing or receiving the Services under any applicable law or regulation;
If entering into this Agreement on behalf of a company or entity, you represent you have the legal authority to bind that entity to this Agreement.
2. Services, Ticket Purchase & Payment
2.1 The Services include: access to the museum premises, exhibitions, events, online ticketing, goods sold via the Site.
2.2 You agree to pay all fees and charges associated with Services you purchase at the time of ordering. The prices are stated inclusive of all applicable Estonian VAT unless otherwise indicated.
2.3 Payment will be processed by [insert payment processor name] or the Company’s designated payment provider.
2.4 After purchase you will receive a confirmation (for example via email). If you have made an error you must notify us as soon as possible.
2.5 Tickets purchased online must be used according to the ticket conditions (validity date, time-slot, non-transferable if applicable).
2.6 The right of withdrawal under the Consumer Protection Act does not apply to leisure services provided at a specific time or date (such as museum visits) once the service has been fully performed or the ticket has been used. [Võlaõigusseadus § 53 (4) p 12].
3. Refunds & Cancellations
3.1 Unless otherwise stated, tickets are not refundable once the date/time of the event or visit is confirmed and the service is performed.
3.2 We will refund your ticket only if the Company cancels the Service (for example the exhibition is cancelled) through no fault of your own. In that event we will notify you and refund the price paid within [X] days.
3.3 If you cannot attend due to your own fault (illness, travel problems etc) the Company is not obliged to offer refund unless agreed separately
3.4 For consumer rights: you may lodge a complaint with the Estonian Consumer Protection and Technical Regulatory Authority (Tarbijakaitse ja Tehnilise Järelevalve Amet) or use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr
4. Use of the Site & Rules of Conduct
4.1 Your use of the Site must comply with all applicable Estonian and EU laws, regulations and this Agreement.
4.2 You shall not:
Use the Site for illegal activities or promote such;
Infringe on intellectual property rights, privacy or publicity rights of others;
Interfere with or disrupt the Site or its servers;
Upload or transmit any viruses, malware, or harmful code;
Copy, distribute or exploit any part of the Site without our prior written consent.
4.3 We reserve the right to suspend or terminate your access to the Site if you breach any of these obligations.
5. Intellectual Property
All content on the Site (text, software, graphics, images, logos, videos, interactive features, trademarks) (“Company Content”) is owned by or licensed to the Company. You may use it only for personal non-commercial purposes. No licences or rights are granted beyond this. Any unauthorised use is strictly prohibited.
6. Liability & Disclaimers
6.1 The Company provides the Site and the Services “as is” and “as available” to the extent permitted by applicable law.
6.2 To the fullest extent possible under Estonian law, the Company disclaims all warranties (express or implied) including fitness for a particular purpose, non-infringement, but without affecting the statutory consumer rights which cannot be excluded.
6.3 In no event will the Company be liable for any indirect, incidental, special or consequential damages, or loss of profits, however caused, arising out of or in connection with your use of the Site or Services. Liability for damage caused by intent or gross negligence remains unaffected.
6.4 Any claim arising out of this Agreement must be brought within one (1) year from the date when the cause of action first arose, unless local mandatory law provides otherwise.
7. Data Protection & Privacy
7.1 By using the Site and purchasing Services you consent to the processing of your personal data by the Company as described in our Privacy Policy.
7.2 We act as controller of your personal data. We process data in compliance with the EU General Data Protection Regulation (EU 2016/679) and the Estonian Personal Data Protection Act (Isikuandmete kaitse seadus).
7.3 You have rights to access your data, correct it, erase it, restrict processing, object and data portability.
7.4 For complaints about data processing you may contact the Estonian Data Protection Inspectorate (Andmekaitse Inspektsioon) at [link].
8. Changes to Terms
We may change these Terms at our reasonable discretion. Material changes will be notified to you at least 14 days in advance (e.g., via email or a notice on the Site). Non-material changes will take effect when posted. Your continued use of the Site after changes signifies your acceptance.
9. Governing Law & Jurisdiction
This Agreement is governed by and construed in accordance with the laws of the Republic of Estonia and applicable EU law. Any dispute under this Agreement shall be subject to the exclusive jurisdiction of the Harju County Court (Harju Maakohus) unless you are a consumer and mandatory consumer protection legislation grants you the right to bring proceedings in your country of residence.
10. General Provisions
10.1 Titles and headings in this Agreement are for convenience only and do not affect interpretation.
10.2 If any provision is held invalid or unenforceable under applicable law, the remaining provisions shall remain in full force.
10.3 No third-party beneficiaries.
10.4 Entire Agreement: this Agreement, together with the Privacy Policy and other documents referenced, represents the entire agreement between you and the Company concerning the Services.
